Introduction The MEES Regulations are now in force.This means that it is now unlawful for landlords to grant new leases, or agree lease renewals/extensions, to new or existing tenants of properties which have an EPC rating of F or G. In addition to these properties which are now deemed ‘unlettable’, properties with existing EPCs of D and E (48% - see Fig. 1 below) are also considered ‘at risk’ due to the inherent inaccuracy of existing EPCs. Whilst the immediate concern for landlords is the prospect of vacant properties within their portfolios, there are also significant impacts to consider for occupied properties.Well-advised tenants are able to use the new legislation to their advantage on areas such as lease negotiations, rent reviews, surrender terms and dilapidations. Here we present the risks to landlords and the associated opportunities available to tenants and investors.
